Membership Terms and Conditions

These terms and conditions (Terms and Conditions) apply to the Busselton Chamber of Commerce and Industry (BCCI) Memberships and to the purchase of BCCI publications.

Our vision is for Busselton to be the best place to live and do business. To achieve this, we listen to the needs of all our stakeholders — businesses, families, consumers and the Busselton workforce. By becoming a Member, you will a part of something bigger and help BCCI achieve this vision.

Membership Years

A membership year for BCCI Membership commences on the date you join BCCI and ends on the 12-month anniversary of joining.

BCCI Membership will continue until a written resignation of membership is received by BCCI.

Membership Fees

You agree to pay BCCI the annual membership fee as detailed in your membership application form or as determined by BCCI from time to time.

The Annual Membership Fees are GST exclusive unless provided otherwise.

BCCI offers two options for payment of the Annual Membership Fees:

  • one-off total payment in full; or
  • 12-monthly instalment payments by direct debit to be given upon request.

One-off payment:

  • The one-off payment of the Annual Membership Fees will be payable in full upfront upon applying for membership (or seeking renewal or reinstatement of membership for subsequent Membership Years (as the case may be)).
  • If your membership is resigned during a Membership Year, the one-off payment of the Annual Membership Fees for that Membership Year will not be refunded.

12-monthly instalment payments:

  • Members may choose to take up the 12-monthly instalment plan for payment of the Annual Membership Fees. This option is only available if payments are received via direct debit and upfront on the start date of the membership period. The first monthly instalment is payable upfront upon applying for membership (or seeking renewal or reinstatement of membership for subsequent Membership Years (as the case may be)) and the remaining balance of the Annual Membership Fee is split equally by the remaining 11 months in the Membership Year. For the remaining 11 months, the direct debit will occur each month on the same day that the first debit order occurred.
  • Members who have chosen to pay the Annual Membership Fees by 12-monthly instalments must ensure that all payments are completed and that the total Annual Membership Fees have been paid by the end of the Membership Year.
  • If a Member chooses to resign their membership prior to the end of the Membership Year, the balance of their Annual Membership Fee (being, all remaining monthly instalments) is due and payable immediately upon resignation.

Resignation and termination

You may resign your membership at any time by written notice to BCCI.

BCCI may terminate your membership if you do not pay your membership fees for more than 30 days after they are due for payment.

Verified Local Tick

Verified Local businesses on the Busselton Chamber of Commerce and Industry (BCCI) website refer to establishments that possess a tangible physical presence within the 6280 and 6281 postcode areas.

Membership Services

BCCI provides its members with a range of services and benefits as part of its membership. The provision of Membership Services is at all times at the absolute discretion of BCCI and is subject to change, variation or cancellation at any time.

Membership Services are provided solely for the use, for the benefit and in the interests, of the Member.

BCCI makes no representation or promises that the Membership Services offered at the time of joining BCCI or renewal of membership will continue to be provided to members.

Member Communications

As part of your membership, you will be subscribed to our newsletter for information relating to your membership. You may also receive news updates, events and training updates, and any other marketing materials we think may be of interest to you. You may unsubscribe from these communications using the link at the bottom of the emails you receive in accordance with our privacy policy (which is available on our website).

Point of Contact for Membership Services

You must nominate one primary point of contact on your membership application form and/or when you join BCCI as a member on the website. The Primary Member Contact is the main point of contact between BCCI and the Member.

Membership Services will only be provided to Members via a Member Contact. Each time an individual seeks to utilise Membership Services, BCCI will verify your BCCI Membership by cross referencing the details of the individual against the Member Contact details that we have on our system.

In the event a Member Contact leaves your organisation, it is your responsibility to inform BCCI as soon as reasonably practicable. BCCI does not accept any liability for any claim which may arise from an individual accessing Membership Services as a Member Contact, if that person is no longer a current employee of the Member and you have not informed BCCI.

Social Media Platforms

BCCI may wish to promote your organisation and refer to you as being associated with BCCI on social media platforms.

By completing a member application form and becoming a Member, you acknowledge and consent to being publicly associated with BCCI and you agree that you may be promoted, referred to and tagged on various social media platforms, including but not limited to, Instagram, Twitter, Facebook and LinkedIn.

You may request to opt out of this at any time. If you do not consent to your organisation being promoted and/or being associated with BCCI on social media platforms, please provide written instructions of your organisation opting out of this feature to BCCI via email to members@busseltonchamber.com.au

Events

By acquiring a ticket to any Event you are agreeing to Busselton Chamber of Commerce and Industry
(BCCI) to share the information you provide on the form with the organisations who are hosting and
sponsoring the event. Those organisations may use your personal information for the purposes of the
event or to contact you in relation to promotional materials which they think may be of interest to you.
BCCI are not responsible for the use of this information by these organisations.

Inappropriate Conduct and Behaviour

When utilising Membership Services, Members and Member Contacts must at all times show courtesy and respect to BCCI staff and observe minimum standards of conduct and behaviour.

If at any time, the conduct or behaviour of a Member and/or Member Contact is reasonably deemed by BCCI to be:

  • inappropriate;
  • harassing, intimidating, overbearing or physically or emotionally threatening;
  • a misuse of the Membership Services (ie for personal use and not for the benefit, or in the interests, of the Member); or
  • contrary to the objects, interests or reputation of BCCI,

BCCI (in its absolute discretion) reserves the right to refuse access to the Membership Services for the period that the inappropriate behaviour/ conduct continues.

Intellectual Property

BCCI owns the intellectual property, including copyright, in all content of its publications.

Reproduction of any BCCI publication is not permitted without prior written authorisation from BCCI. If BCCI grants permission, you must give appropriate attribution to the author and date of first publication.

Members are not permitted to use the BCCI name or logo, including on their websites or business stationery or to suggest that they are sponsored, endorsed by, or affiliated with, BCCI without obtaining prior written authorisation from BCCI. You acknowledge that all decisions as to whether to permit your use of the BCCI name or logo are made by BCCI in its absolute discretion.

No Liability for Third Party Products and Services.

By accessing and using third party products and services, you acknowledge that you have read and understood the terms and conditions (and privacy policy) of that third party and agree to by bound by them.

To the fullest extent permitted by law, BCCI excludes all liability including for any direct, indirect or consequential loss or damage suffered by any person accessing and/or using third party products and services.

Privacy

BCCI is committed to protecting your privacy and ensuring that your contact with BCCI is a safe and rewarding experience.  BCCI has a privacy policy to manage privacy.  A copy of BCCI’s privacy policy is available on our website.

By submitting a membership application form, you acknowledge that you have read and understood the BCCI privacy policy and you agree with, and consent to, the practises described in that policy.

General

Changes to Terms and Conditions

From time to time, BCCI may update these Terms and Conditions. The updated Terms and Conditions will apply to all memberships from the time of posting on our website and onwards.

Inconsistency

In the event of any inconsistency between these Terms and Conditions and the Constitution, the Constitution prevails.

Severability

Any provision of, or the application of any provision of, these Terms and Conditions which is void, illegal or unenforceable in any jurisdiction does not affect the validity, legality or enforceability of that provision in any other jurisdiction or of the remaining provisions in that or other jurisdiction.

Governing Law

These Terms and Conditions are governed by the laws of Western Australia.  Each party irrevocably submits to the non-exclusive jurisdiction of the courts of Western Australia.

Transferability

Membership, and the rights of being a BCCI member, are personal to the member and are not transferable.

Member Terms and Conditions

If you supply your terms and conditions on any document at any time (including on purchase orders or other documents) your terms and conditions will be of no legal effect and will not constitute part of these Terms and Conditions for the provision of Membership Services, even if a representative of BCCI signs a document that indicates that your terms and conditions apply.
